Terms of Service

Welcome to NickLepore.com and Gallery.NickLepore.com (together, the "Site"). The Site is operated by Nick Lepore, a sole proprietor based in Minnesota ("I," "me," or "my"). By using the Site, viewing galleries, purchasing prints, or contacting me through any form, you agree to these Terms of Service.

If you do not agree to these terms, please do not use the Site.

1. Use of the Site

You may browse the Site for personal, non-commercial use. You agree not to:

Download, copy, redistribute, or republish any photograph or content on the Site without my written permission
Use any image for commercial purposes, including resale, advertising, training of machine learning models, or inclusion in any product
Modify, crop, edit, or remove watermarks or metadata from any image
Use automated tools (scrapers, bots, crawlers) to access or copy content
Misrepresent your identity, attempt to circumvent access controls, or interfere with the Site's operation

2. Galleries and Image Delivery

Some galleries are public; others may be password-protected and intended for specific groups (event participants, family members, etc.). If you receive access to a private gallery, you agree not to share access credentials with others.

If you appear in a photograph on the Site and would like it removed, please contact me using the contact form. I will honor reasonable removal requests promptly, particularly for photographs of minors.

Photographs of public events (including tournaments, community events, and similar gatherings) may be posted without individual model releases where the organizing body has authorized photography. If you have concerns about a specific image, please contact me.

3. Prints and Purchases

Prints and other products are sold through secure third-party payment processors (currently Stripe and/or Square). I do not store your full payment card information.

Pricing: All prices are listed in U.S. dollars and are subject to change. Sales tax will be added where required by Minnesota law.

Shipping: Estimated shipping times will be provided at checkout. I am not responsible for delays caused by shipping carriers.

Returns and Refunds: Because prints are produced to order, all sales are generally final. If your print arrives damaged or defective, contact me within 14 days of delivery with photos of the issue, and I will arrange a replacement or refund at my discretion.

Cancellations: Orders may be cancelled if they have not yet entered production. Once production has begun, cancellations are not guaranteed.

4. Bookings and Services

If you book photography services through the Site, a separate booking agreement may apply. Deposits, cancellation policies, deliverables, and licensing terms will be specified in that agreement. These Terms govern your use of the Site itself, not the terms of any photography services contracted separately.

5. Intellectual Property

All photographs, designs, text, and other content on the Site are owned by me or used with permission. Purchase of a print grants you the right to display that physical print for personal use only. It does not transfer copyright, reproduction rights, or commercial use rights.

If you would like to license an image for commercial use, contact me to discuss terms.

6. Third-Party Services

The Site uses third-party services for payments (Stripe, Square), hosting, email, and analytics. Your use of those services is governed by their own terms and privacy policies. I am not responsible for the practices of third-party services.

7. Disclaimers

The Site is provided "as is" without warranties of any kind. I make no guarantees that the Site will be uninterrupted, error-free, or secure. Galleries may be added, removed, or changed at any time.

8. Limitation of Liability

To the maximum extent permitted by law, I am not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Site or any products purchased through it. My total liability for any claim related to the Site or a product purchase is limited to the amount you paid for the product in question, or $50, whichever is greater.

9. Changes to These Terms

I may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of the Site after changes constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Hennepin County, Minnesota.
